ZBA PUBLIC HEARING

A Public Hearing will be held on Thursday, August 4th, 2022, at 6:00 P.M. at 250 Broadway to consider the following application for an Area Variances and Use Variances.

  1. Daughters of Charity, 98 Menand Road, Area & Use Variance
  2. Joe Vellano, Daycare Business, 31 North Lyons Avenue, Use Variance
  3. 5 Elmwood Road, Warehousing with Wholesale and Distribution, Use Variance

Daughters of Charity, 98 Menand Road is in an “R” Zone. Chapter 169 Schedule “A” does not list this proposed development as a “Principal Use Permitted by Right” or a “Use Permitted by Special Permit”, therefore, it is not allowed in an “R” Zone. Also, Chapter 169 Schedule “B” states in an “R” Zone the maximum building height is 35’ and the number of stories is 2 ½; the primary building height is 79’ and exceeds 2 ½ stories tall.

Joe Vellano, Daycare Business, 31 North Lyons Avenue based in Chapter 169, Schedule “A” in the Village of Menands and Zone “R-1” is not a Principal Use permitted by Right or a Use Permitted by Special Permit, therefore, the Daycare Business can not be in the “R-1” Zone.

Andy Brick, 5 Elmwood Road based on the information provided in the submitted building permit application stating the potential use at the property located at 5 Elmwood Road of “Warehousing with wholesales and distribution” is not a principal use permitted by right or a use permitted by special permit in the T-4 Zone.
