ZBA PUBLIC HEARINGS

A Public Hearing will be held on Tuesday, April 18th, 2023, at 6:00 P.M. at 250 Broadway to consider the following applications for an Area Variance and Use Variance.

  1. Continuation of Public Hearing for Daughters of Charity, 96 Menand Road, Area & Use Variance
  2. Park South Real Estate Corp  50-56A Clifford Road

Daughters of Charity, 96 Menand Road is in an “R” Zone. Chapter 169 Schedule “A” does not list this proposed development as a “Principal Use Permitted by Right” or a “Use Permitted by Special Permit”, therefore, it is not allowed in an “R” Zone.  Also, Chapter 169 Schedule “B” states in an “R” Zone the maximum building height is 35’ and the number of stories is 2 ½; the primary building height is 79’ and exceeds 2 ½ stories tall.

Also, a Public Hearing  Park South Real Estate Corp, 50-56A Clifford Road applied for a Use Variance. The applicant wants to construct 4 additional buildings on the property.  The buildings will have four residential apartments each.

Based on Chapter 169, 12 units per acre are allowed in a R3A Zone.  The applicant wants to purse 15 units as the denial will show.
