The Special Meeting of the Board of Trustees of the Village of Menands, held on Wednesday, July 15, 2026, was called to order by Mayor Brian Marsh at 6:00 P.M.

The Mayor led the Pledge of Allegiance and stated that this meeting is recorded.

Mayor Marsh and Lauren Paulsen from LaBella advised the purpose of this meeting to set a date for Public Hearing regarding The Village of Menands is proposing to undertake the Menands Lead Service Line Replacement Project to remove and replace existing lead and galvanized water service lines throughout the Village. The project is being advanced to comply with current drinking water regulations, improve public health protection, reduce potential lead exposure in drinking water, and provide long-term, reliable, lead-free water service to residents and businesses. Such hearing to be held prior to the regular meeting set for July 20, 2026, and to declare a Type II Action under SEQRA and that no further environmental review is required. Mayor Marsh explained the reason for the need to bond the monies for the Grant. Discussion followed.

The Village of Menands is proposing to undertake the Menands Lead Service Line Replacement Project to remove and replace existing lead and galvanized water service lines throughout the Village. The project is being advanced to comply with current drinking water regulations, improve public health protection, reduce potential lead exposure in drinking water, and provide long-term, reliable, lead-free water service to residents, businesses, and public facilities.

As part of the funding application process, compliance with the State Environmental Quality Review Act (SEQRA) is required. Therefore, this memorandum documents the SEQRA review process completed for the proposed project and provides the basis for the recommended SEQRA classification determination.

Project Scope:
The proposed Menands Lead Service Line Replacement Project consists of the removal and replacement of existing lead and galvanized water service lines connected to the Village’s existing public water distribution system. Work will include coordination with property owners; excavation or trenchless replacement of affected water service lines; installation of new compliant water service piping extending from the existing municipal water main to the building connection; reconnection to the existing water distribution system; and all associated appurtenances necessary to restore potable water service.

Construction activities may include pavement saw cutting, excavation within existing public rights-of-way and private property, traffic control, utility coordination, dewatering, backfilling, compaction, installation of new service piping, testing, flushing, and surface restoration. Existing lead service materials will be removed and disposed of in accordance with all applicable federal, state, and local requirements.
The project also includes full restoration of all disturbed areas to conditions equal to or better than those existing prior to construction. Restoration activities may include replacement or repair of streets, sidewalks, curbs, gutters, driveways, aprons, retaining walls, steps, landscaping, lawns, fences, and other permanent improvements disturbed during construction using materials and workmanship consistent with municipal standards and existing site conditions.

The proposed work is limited to replacement and rehabilitation of existing water service infrastructure serving existing developed properties. The project will not expand the Village water distribution system, create new water districts, extend water service into previously undeveloped areas, or increase the capacity of the existing public water system. Rather, the project is intended to replace aging lead and galvanized service lines with modern compliant materials to improve drinking water quality, public
health protection, system reliability, and long-term regulatory compliance.

Recommendation of Determination:
Based upon the proposed scope and nature of improvements, it is LaBella Associates’ recommendation that the project be classified as a Type II Action pursuant to the State Environmental Quality Review Act (SEQRA). Type II Actions are not subject to further review under SEQRA pursuant to 6 NYCRR Part 617.5. The proposed action is consistent with one or more of the following Type II classifications contained within 6 NYCRR 617.5(c):

(1) maintenance or repair involving no substantial changes in an existing structure or facility;

(2) replacement, rehabilitation, or reconstruction of a structure or facility, in kind, on the same site, including upgrades necessary to meet current codes, regulatory requirements, and design standards, unless such action meets or exceeds any threshold contained in 6 NYCRR 617.4;

The proposed project will not involve the creation of new water districts, expansion of the Village water distribution system, extension of public water service into previously undeveloped areas, substantial increases in system capacity, or significant disturbance of undeveloped land. Work will occur within existing developed roadway corridors, utility easements, and developed private properties served by the existing municipal water system, with all disturbed areas restored following construction.

Therefore, it is LaBella Associates’ opinion that the proposed Critical Water Source and Storage Improvements Project constitutes a Type II Action under SEQRA and is not subject to further environmental review.

STATE ENVIRONMENTAL QUALITY REVIEW ACT RESOLUTION FOR THE
VILLAGE OF MENANDS LEAD SERVICE LINE REPLACEMENT PROJECT

WHEREAS, the Village Board of Trustees of the Village of Menands (the “Board”) is considering the following proposed scope of work:
The Village of Menands proposes the removal and replacement of existing lead and galvanized water service lines throughout the Village to improve public health protection, reduce potential lead exposure in drinking water, and provide long-term, reliable, lead-free water service. The proposed project includes coordination with property owners; excavation or trenchless replacement of affected water service lines; installation of new compliant water service piping from the existing municipal water main to the building connection; reconnection to the municipal water distribution system; testing and flushing of new service lines; proper removal and disposal of lead service materials; and restoration of all disturbed areas, including streets, sidewalks, driveways, landscaping, and other permanent improvements. The proposed work will occur within existing developed roadway corridors, utility easements, and private properties currently served by the existing municipal water distribution system.
WHEREAS, the Board has reviewed the scope of the project and has further received and considered the advice of its engineers and environmental professionals with respect to classification of the action in accordance with the State Environmental Quality Review Act (SEQRA); and
WHEREAS, the Board has reviewed the Proposed Action with respect to the Type II criteria set forth in 6 NYCRR Part 617.5(c), including the following:
(1) maintenance or repair involving no substantial changes in an existing structure or facility; and
(2) replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrades necessary to meet current codes, regulatory requirements, and design standards, unless such action meets or exceeds any threshold contained in 6 NYCRR 617.4;
WHEREAS, the proposed project consists of the replacement and rehabilitation of existing municipal water service infrastructure serving existing developed properties and does not involve the creation of new water districts, extension of water service to previously undeveloped areas, or substantial expansion of the capacity of the existing public water system; and
WHEREAS, the proposed project is a Type II action meeting one or more of the aforementioned Type II criteria; and
WHEREAS, Type II actions have been determined not to have a significant impact on the environment and are not subject to further review under SEQRA;
NOW, THEREFORE, BE IT RESOLVED, that the Village Board of Trustees hereby determines that the proposed Village of Menands Lead Service Line Replacement Project constitutes a Type II Action under SEQRA, and that no further environmental review is required.
