Board Meeting Minutes – September 6th, 2016

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Tuesday, September 6th, 2016 was called to order by Mayor Megan Grenier at 6:00 p.m.

Also attending: Bill Garvey, Brian Marsh, Paul Cooney, John Stangle, Kirk Montanye, Connie Van Buren, Diane Brunelle, Dianne MacFarland, Greg Beswick, and Travis Rosecranse.

The Mayor led the Pledge of Allegiance.

At 6:00 P.M. the Mayor opened the public hearing for proposed Local Law # 6 to amend Chapter A172 of the Village Code adding new section A172-4.

4. The Village may require an applicant to deposit in escrow a reasonable amount established by the Village to pay for fees and/or costs of any engineer, consultant or attorney designated or hired by the Village to review any application for a building permit, site plan review or approval of such application. The fee and/or costs charged by such engineer, consultant or attorney in connection with such review will be charges against the sum deposited in escrow. Any amount held in escrow will be at the sole discretion of the Village. Any amount remaining shall be returned to the applicant within 45 days of final action on the application.

Resident Paul Cooney asked who and how would determine the amount of money that would be deposited in Escrow. Village Engineer Eric Johnson responded.

Resident Diane Brunelle asked if this would apply to private residences as well. The Mayor and Village Attorney responded.

Hearing no further questions the Mayor closed the public hearing at 6:05 P.M.

The regular meeting reconvened at 6:05 P.M.

Greg Beswick and Travis Rosecranse of Creighton Manning who are representing U-Haul of Menands, Inc. gave a conceptual presentation of a proposed 5,000 sq. ft. storage facility at 40 Simmons Lane. They also said they will be addressing Chazen’s concerns.

Open Forum:

Resident Rene Fields of Clifford Road informed the Board that a tree fell recently on her street near her car and she wanted to thank all the parties involved who acted so promptly to her issue. Sgt. Westfall and Officer Barnes from the Police Department, the Menands Fire Department, Mike Hagmann and the DPW, Treasurer Bill Smith and Clerk John Berry.

Resident Bill Garvey commented that the house on 60 Menand Road had overgrown grass and bushes.

He also would like to offer his help in cleaning up after the Fire Company picnic on Sunday, September 11th.

Bill reported that street marker sign #72 was knocked over and that he would like to see Mystic Evergreen trees planted in the park.

Resident Connie Van Buren stated that residents don’t clean their property on Clifford Road and they park their cars on the lawns.

She also noted that the old carwash on Broadway as well as the new owners of Mancini’s need to clean up their properties.

Resident Brian Marsh asked if there was any news yet on Van Rensselaer Blvd. Mayor Grenier responded.

Resident John Stangle said that the Humane Society needs to take care of their property.

He also said that our Police Department should not be patrolling I 787 on Saturday. They should be patrolling our residential communities.

Resident Kirk Montanye expressed his opinion on apartments in Menands and commented on the car wash.

A motion was made by Trustee Nicoll, seconded by Trustee Boulet to accept the minutes of the August 15th, 2016 Board Meeting.

A motion was made by Trustee Harris, seconded by Trustee Nicoll to approve payment for the following:

WARRANT # 7:

GENERAL totaling $333,506.56
WATER totaling $ 13,780.67
SEWER totaling $378,291.87
TOTALS $725,579.10

PAYROLL # 7: totaling $100,910.49

PAYROLL # 8: totaling $ 80,544.85
(09/02/16 – 09/15/16)
TOTALS $181,455.34

The Clerk reported that after the Board came out of Executive Session after the August 15th meeting, the Board awarded the 2016 Village of Menands Road Improvements Project to Callanan, Inc., who was the lowest responsible bidder.

The bids were as follows:

Peter Luizzi Brothers $194,525.00
Callanan, Inc. $238,480.00
Rifenburg Construction, Inc. $247,867.50
Delsignore Blacktop Paving $267,375.00

The Code Enforcement Officer reported that there is a day care that opened in Menands that the Village just found out about. It’s not permitted, and the owner will have to get a Zoning Permit.

A motion was made by Trustee Harris, seconded by Trustee Foley to approve proposed Local Law # 6 of 2016 that would amend Chapter A172 of the Village Code adding a new Section A172.4.

Trustee Foley made a motion, seconded by Trustee Harris to approve a leak study for the entire Village by New York State Leak Detection.

At 6:40 P.M. Trustee Harris, seconded by Trustee Foley to enter into Executive Session to discuss a legal matter.

The regular meeting reconvened at 7:20 P.M.

Trustee Boulet made a motion, seconded by Trustee Foley to make a final payment of $17,000.00 to Weston & Sampson for the Van Rensselaer Blvd. Project.
