Board Meeting Minutes – November 5th, 2018

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, November 5th, 2018 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

Open Forum:

Resident Bill Garvey thanked the Menands Police for contacting National Grid regarding the street lights that are out near the pump station.

Resident Garvey thanked DPW for the following: fixing the stop sign at Canal Road and Simmons Lane, the green bench at the park and hydrant flag on South Lyons Avenue.

Resident Garvey asked the Board if they had a chance to read the letter, he received from CP Rail. They replied yes.

Resident Brian Marsh advised the Board the power went out again Saturday at 2:00 AM and he is going to pursue this with National Grid.

Resident James Sher asked if the Quiet Zone is going to be for the whole Village. Mayor Grenier advised yes.

James asked the status Mayor Grenier explained that CP Rail is doing a study that could that take up to six months.

James asked where the storm drains actually drain into. Eric Johnson explained that they end up in the Hudson River. A discussion followed.

Resident Sher asked about coyotes on his property does he have the right to shot them if he feels threatened. A discuss followed. Mr. Sher was advised to contract Police Chief.

Resident Sher complained about people running the red light in front of 444 Broadway at 7:00 AM.
The Clerk will advise police.

Resident Sher asked about the Leash Law and a neighbor that refuses to put her dog on a leash early in the morning. Resident Sher spoke to the Clerk about this and the Clerk advised the Police, who spoke to the resident. But the resident still lets the dog out without a leash. The Clerk will advise the police.

Dr. Maureen Long, Superintendent of the Menands Union Free School thanked, everyone that attended the ground breaking for the Menands School addition. She also gave the Clerk the Menands School news letters to hand out.

A motion was made by Trustee Harris to approve minutes from the October 15th, 2018 Board Meeting, seconded by Trustee Foley.

A motion was made by Trustee Boulet to approve minutes from the Health Insurance Workshop held on October 29th, 2019, seconded by Trustee Foley.

A motion was made by Trustee Nicoll to approve payment for the following, seconded by Trustee Boulet.

Trustee Harris moved the following resolution concerning Health, Dental, and Vision Insurance for eligible Village Employees and retirees. For the calendar year 2019 the Village will offer the following
plans:

Empire Blue Cross Platinum Blue Access EPO 15/0%/3500; and Empire Blue Cross Gold Blue Access EPO 25/0%/6000; along with the current Guardian Dental and Vision Plans. On January 1st eligible employees will have an 18% employee responsibility, however, beginning with the Fiscal year June 1st, 2019 the employee responsibility will increase to 19% of the total monthly cost of the Health, Dental, and Vision options selected. (Union contracts will supersede the % of employee responsibility and Health Plans). Non-Medicare retires will have the same health care choices (except without Dental and Vision Coverage) with a retiree responsibility of 12%. Medicare eligible retirees will continue to be offered the CDPHP Medicare Advantage Plan with a 12% retiree responsibility. The resolution was seconded by Trustee Foley.

Treasurer Smith led a discussion regarding changing from Logics, LLC software back to KVS. Trustee Nicoll made a motion if there is no penalty to switch to KVS to start working on the transfer. Treasurer Smith expects it to take place in approximately three months, therefore, it will be some time in the spring, seconded by Trustee Foley.

RESOLUTION
(Albany County Hazard Mitigation Plan)
WHEREAS, the County of Albany, with the assistance of Barton & Loguidice, D.P.C., and the participation of the Village of Menands, gathered relevant information and prepared the Albany County Hazard Mitigation Plan; and

WHEREAS, the Albany County Hazard Mitigation Plan (the “Plan”) (available at http://www.albanycounty.com/govemment/departments/departmentofpublicworks.aspx) has been prepared in accordance with the Disaster Mitigation Act of 2000 (Public Law 106-390) which requires the adoption of state and local hazard mitigation plans as a condition for Federal disaster assistance;
WHEREAS, the Federal Emergency Management Agency and NYS Division of Homeland Security & Emergency Services have approved the Plan;

WHEREAS, the Village of Menands and its departments actively participated in the preparation of the Plan and worked closely with the County’s consultant;

WHEREAS, at a public hearing on July 27, 2017, the County of Albany, upon behalf of the Village of Menands, afforded residents with an opportunity to comment and provide input on the Plan and its proposed actions; and

WHEREAS, the Village of Menands has reviewed the Plan and affirms that the Plan shall be updated not less than every five years;

NOW THEREFORE, BE IT RESOLVED that the Village Board of the Village of
Menands adopts the Albany County Hazard Mitigation Plan as the Village of Menands Hazard Mitigation Plan, and resolves to execute the actions in the Plan.

Trustee Harris made a motion to accept the resolution to participate in the Albany County Hazard Mitigation Plan, seconded by Trustee Foley.

A discussion was held regarding Albany County Health insurance Consortium. Trustee Boulet made a motion authorizing the Clerk to sign letters to current Health Companies requesting claim data to be used to get pricing for county wide health insurance consortium this is a non-binding agreement, seconded by Trustee Harris.

RESOLUTION OF THE VILLAGE OF MENANDS IN SUPPORT OF PARTICIPATION IN A COMMUNITY CHOICE AGGREGATION PROGRAM TO NEGOTIATE AND ENTER INTO ENERGY SUPPLY CONTRACTS WITH ENERGY SERVICE COMPANIES.

WHEREAS, it would benefit the Village of Menands to explore opportunities to further reduce energy costs and a carbon emissions; and

WHEREAS, Community Choice Aggregation (“CCA”) is a municipal energy procurement model approved by the New York State Energy Resource and Development Authority (NYSERDA) that allows local communities to create an entity that will become the default supplier of electricity for homes and small businesses within a town, city, or village’s jurisdiction; and

WHEREAS, the CCA model puts control of choosing an energy supplier in local hands; and

WHEREAS, by pooling demand, CCA enables communities to negotiate lower rates with private suppliers and choose cleaner energy;

NOW, THEREFORE LET IT BE ROSOLVED, that the Village of Menands seeks opportunities to expand access and reduce energy costs for residents and businesses while also reducing greenhouse gas emissions; and

BE IT FURTHER RESOLVED, that the Village of Menands supports and encourages the formation of a CCA for its potential to offer its residents and businesses lower energy costs and cost certainty while increasing their access to renewable energy and promoting investment in renewable energy generation infrastructure.

Trustee Boulet made a motion for the Village of Menands to participate in a community choice aggregation program, seconded by Trustee Nicoll.

The Clerk stated he received a request from the Menands Fire Company No 1 for permission to repaint the 3 bathrooms. The Board felt it was ok.

The Clerk advised the Board that the Village Offices, Court and DPW will be closed Monday, November 12th in observance of Veterans Day.

The Clerk and Eric Johnson advised the Board that Eric Johnson is working with the Code Enforcement Officer Lyle Darmetko to update Building Department forms and rates. A discussion followed.

Mayor Grenier read the Halloween Party Report.

The Mayor read a letter from DOT and advised the Board of the meeting held with DOT, CDTA, and the Village regarding Broadway Bike Lane, a bike lane to the Albany County Bike Path and a proposed road diet to Broadway. The meeting went very well, with a lot of dialog both ways. There will be more meetings.

Trustee Nicoll read a letter from Capital Roots asking about putting bike repair station, and bike stands on Broadway. The Board approved Trustee Nicoll to be the liaison to this program. Dr. Maureen Long stated she would also bring the subject up to school.

At 6:40P.M. Trustee Boulet made a motion to enter into Executive Session to discuss a legal matter, seconded by Trustee Nicoll.
