Board Meeting Minutes – May 16th, 2016

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, May 16th, 2016 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

At 6:00 P.M. the Mayor opened the public hearing on the proposed Local Law # 2 of 2016 Parking of Junked Vehicles or Vehicles on Landscaped Areas amending Code of the Village of Menands Chapter 110 JUNKED VEHICLES.

A number of residents spoke against and in favor of the amendment.  After which the Mayor informed the residents that the Board has sixty-two (62) days to vote on the purposed amendment.

Hearing no other questions or comments the Mayor closed the public hearing at 6:43 P.M.

The regular semi-monthly meeting reconvened at 6:44 P.M.

Mr. Arcangel from Columbia Development Corp. gave a presentation to expand 431 Broadway, the old Two Guys Department Store building.  With the additional jobs scheduled to be a part of the building, Mr. Arcangel stated that the biggest complaint is that there aren’t many places to eat, and he also reported purposing a new deli that could service the employees there.  He also said that he would most likely be back at the next meeting with elevation measurements.

Ms. Theresa Zubretsky from the Capital District Tobacco Free Coalition gave a presentation on Tobacco Free Parks.  She informed the Board that there are examples of ordinances and laws that the Village might use on their website.  She said that Tompkins County has the most detailed law.  Theresa also showed the Board signs that are available for use in the park that are at no cost to the Village.  They are provided by the NYS Department of Health.

Open Forum:

Resident Danielle Churchill feels that the use of pesticides in our community is happening more frequently.  She also said that the Board should have had a discussion with the residents before the Village acted on this.  The Mayor and the Village Clerk responded. Ms. Churchill also asked if anyone would be willing to begin discussions on the least toxic chemicals to use on public property.

Danielle suggested that we should have notified the residents that we would be spraying the park area as well as the school path.  The Clerk responed.

Resident Bill Garvey asked when the street signs on Harts Lane would be fixed.  Trustee Boulet responded.  Mr. Garvey also said that he forwarded a tree proposal to the Trustees and suggested that the Village could get volunteers to pant the trees.

Resident Mike Steurer asked what the next steps would be in the process of voting for the proposed public law.   The Mayor responded.

Resident Bill Nevins suggested that we could have a fundraiser to purchase the trees for the park.

Resident Brian Marsh said that it was nice to see that the Two Guys building would be expanding.

Mr. Marsh also noted that in the December 21, 2015 Board Minutes, there was an authorization for the purchase of 280 Broadway.  He said that the Board should make an amendment to those minutes to add the cost of the building.

Brian said that in those same minutes the Village was requesting a loan to the Water Fund and is the Village taking the necessary steps to address the owner of the outstanding reassessed water account.  The Village Attorney responded.

Mr. Marsh asked when the Village would be meeting with the NYS Department of Transportation on Van Rensselaer Boulevard.

Resident John Stangle said that he would assume that the vote for the proposed local law will be on the agenda.  He also said that he hadn’t seen anything further in the meeting minutes for the purchase of the building.

A motion was made by Trustee Harris, seconded by Trustee Boulet to accept the minutes of the May 2nd, 2016 Board Meeting.

Amendment to 160-31 of the Code of the Village of Menands:

160.31. Exclusion of heavy trucks from certain Village highways/streets

(a).  Glenwood Road between Broadway and the access road to the Menands overcrossing, Wolfert Avenue between Van Rensselaer Boulevard and North Pearl Street, Amsterdam Avenue between Van Rensselaer Boulevard and North Pearl Street and Hendrick Avenue between Van Rensselaer Boulevard and Amsterdam Avenue are hereby designated as highways in the Village of Menands from which heavy trucks shall be excluded

(b). The regulations established in this section shall not apply to the following:

Commercial vehicles while they are actively engaged in the delivery or pickup of merchandise or other property to a residential address along the highways from which such vehicles are otherwise excluded

Authorized emergency vehicles engaged in emergency operations along the highways from which such vehicles are otherwise excluded.

All public transit buses or any other vehicles providing services to the persons or property along the highways from which such vehicles are otherwise excluded.

160.36. Designation.

Wolfert Avenue, a public highway in the Village of Menands and not being a state highway maintained by the state, is hereby designated as a main artery of travel in said Village.  REPEAL

 

A motion was made by Trustee Foley introducing a resolution amending §160-31 of the Village Code “Exclusion of heavy trucks from certain Village highways/streets and repeal §160-36 Designation of Wolfert Avenue as a Main Artery of Travel.

Village of Menands

Resolution: Lead Agency Declaration

WHEREAS: the State Environmental Quality Review Act requires that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and

WHEREAS: State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and

WHEREAS: Village of Menands Village Board authorized an update for the sign regulations, adding Planned Development District language, and map changes on 12/21/15 with Resolution for proposed Local Law #3 of 2016, and

WHEREAS: Village of Menands Village Board is considering the adoption of these proposed amendments, and

WHEREAS: this is a Type 1 Action pursuant to the New York State Environmental Quality Review Act, (SEQRA) which requires review, and

WHEREAS: NYS Municipal Home Rule Law and the Statute of Local Governments provide independent power to adopt, amend and repeal zoning regulations via the adoption of local laws.

NOW, THEREFORE BE IT RESOLVED: that the Village of Menands Village Board declares itself Lead Agency in Environmental Review for the proposed revisions and adoption of the Village of Menands Zoning Code.

            TAX LEVY RESOLUTION

 

A resolution levying the total taxes and other charges extended and levied against each parcel of real property shown on the roll prepared and verified by the Treasurer for the 2016 – 2017 fiscal year.

A motion was made by Trustee Harris, seconded by Trustee Foley to adopt the following Resolution.

RESOLVED, that there be levied and assessed against the real property of the Village of Menands the following sums for village government and other charges for the fiscal year 2016 – 2017 with a tax rate of $7.46 per thousand assessed value:

The Clerk reminded the Board of the Business Breakfast scheduled for Wednesday, May 25th at 7:30 A.M. in the Village Hall.

At 8:03 P.M. Trustee Nicoll made a motion, seconded by Trustee Foley to enter into Executive Session to discuss a legal matter.

The regular meeting reconvened at 8:25 P.M.

A resolution was introduced by Trustee Harris, seconded by Trustee Foley authorizing the Mayor to enter into negotiations with the Mayor of Cohoes, for the potential sale of the ladder truck.  The Mayor will ask Chief Franklin to obtain a written appraisal reflecting the current value of the ladder truck.
