Executive Session:

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands held on Monday, May 15th, 2023, was called to order by Mayor Megan Grenier at 6:00 P.M.

The mayor led the Pledge of Allegiance.

Mayor Grenier opened the Public Hearings at 6 PM.

The Clerk read the following notice:

There will be a Public Hearing held on Monday, May 15, 2023, at 6:00 P.M. regarding Local Law #5 of 2023 a Local Law Amending Chapter 169, “Zoning of The Menands Village Code by Adding Schedule 4, Frontage Types and Law #6 of 2023, A Local Law Amending the Menands Village Code by Repealing Chapter 30, “Planned Development Districts”, Chapter 100, Gasoline Stations”, Chapter 140 “Site Plan Review”. and Chapter A172, “Site Plan Review Regulations”.  All are encouraged to attend and comment at or to present comments in writing to Clerk Handerhan before noon on May 15, 2023, at email hidden; JavaScript is required. Matt Rodgers from LaBella led a discussion regarding Local Law #5 of 2023 a Local Law Amending Chapter 169, “Zoning of The Menands Village Code by Adding Schedule 4, Frontage Types and Law #6 of 2023, A Local Law Amending the Menands Village Code by Repealing Chapter 30, “Planned Development Districts”, Chapter 100, Gasoline Stations”, Chapter 140 “Site Plan Review”. and Chapter A172, “Site Plan Review Regulations”.
Resident Bill Garvey supports Local Laws 5 and 6 of 2023.

Hearing no further comments, the mayor closed the Public Hearing at 6:06 P.M.

He has Village items of concern and importance they are:

  1. He approves of the decision to increase water/sewer rates.
  2. He supports the replacement of water/sewer lines in the south end.
  3. He was happy to hear that Bethany Church has been sold.
  4. He saw a sign blocking a hydrant on South Lyons Avenue.
  5. He was happy to hear that bleacher at the Little League Field had been repaired.
  6. He helped Karyn Steurer repaint 2 dugouts.
  7. He was happy Railroad Ave was renamed Station Street.
  8. He questioned the location, number, and income from the Electric Charging Stations.
  9. He has requested new doors for the men’s/ladies’ room at LL Field.
  10. He urges the Board to pass LL # 4 of the 2023 Utility Gross Receipts Tax.

Resident Chuck Price asked about Fusion Recovery and if there was any resident input, meetings, or hearings.  Mr. Price wanted to know how the Board stands on Fusion Recovery.  A discussion followed.

Resident Laura Harbour advised the Board there are many new residents at the heart of the Village that are not aware of what to do during a Train Emergency.  Ms. Harbour also stated that it has been several years since a train emergency drill.  A discussion followed.

After a discussion, the Board recommends holding a Train Emergency Drill and asking the Railroad to complete the easement of the railroad tracks.

Ms. Harbour asked if the Village has policy regarding light pollution.  A discussion followed.

Ms. Harbour asked if the purchase of Bethany Church needs to go to the ZBA.  A discussion followed.

Ms. Harbour also thanked Mayor Grenier and Trustee Foley for their years of service.

Budget Shortfall

Resolution Number 230209

The Treasurer requests the Board amend the 2022-2023 Fiscal Year Budget to cover the costs of repairs to Rescue 6 that the Board approved at the 4/3/23 Board meeting.  He requests that Account A.341.0491 be increased by $16,000 to cover the repair costs of Rescue 6.  After a discussion, Trustee Lane moved, seconded by Trustee Marsh the following.  A resolution authorizing the Treasurer to amend the 2022-2023 Fiscal Year Budget by $16,000 to Account A.3410.0419 Fire Vehicle Maintenance.

A discussion was held regarding approving Local Law #6 of 2023, A Local Law Amending the Menands Village Code by Repealing Chapter 30, “Planned Development Districts”, Chapter 100, Gasoline Stations”, Chapter 140 “Site Plan Review”. and Chapter A172, “Site Plan Review Regulations. Tabled until June 26, 2023, Board Meeting.

The Clerk led a discussion regarding the installation of outlets at Ganser Smith Park. Outlets would be installing outs in the following locations; 2 outlets outside of the upper bathrooms, 1 outlet near the evergreen tree near the gazebo, and 1 each on the light poles within the park. The Clerk advised the Board of the following quotes to install outlets at Ganser Smith Park:

After a discussion, Trustee Marsh made a motion to approve the quote to install outlets at Ganser Smith Park by Kasselman Electric at a cost of $3,925.00, second by Trustee Foley.

The Clerk led a discussion regarding repairs needed for DPW Truck 3.  Truck 3 is the dump truck used for salting during the winter, used to transport soil and rocks to and from water main breaks, and transporting topsoil, and asphalt. The truck has been hard to start. DPW brought the truck for an inspection and to look at why it was hard to start. While diagnosing the reason for being hard to start the service company found 3 cylinders of low compression and a lot of metal in the oil.  Their recommendation is to replace the engine.  A discussion followed.

After the discussion, the Board decided not to replace the engine.  The Board wants DPW Foreman to investigate available used dump trucks.  A discussion followed.

Mayor Grenier advised the Board that 35 Broadway has received state funding and will be moving forward.  A discussion followed.

Dear Mr. Alexy:
The Village of Menands is submitting this Affirmation and Renewal letter as required by 49 CFR 222.47(b) for the Quiet Zone that was established in December 2020. The Quiet Zone is a partial Quiet Zone, operating from 10:00 p.m. until 7:00 a.m., and encompasses four highway-rail grade crossings in the Village. The four highway-rail grade crossings include:

  • DOT Crossing Inventory Number 250029L, Cemetery Road
  • DOT Crossing Inventory Number 250031M, Menand Road
  • DOT Crossing Inventory Number 250032U, Brookside Avenue
  • DOT Crossing Inventory Number 250035P, Simmons Lane

New traffic counts for each crossing were collected in April 2023. Attached are the edited Grade Crossing Inventory forms showing the updated traffic data in Part V: Public Highway Information for each crossing.
For the Quiet Zone implementation, “No Train Horn” warning signs were added at each crossing along with new signing and striping such as centerlines, stop bars, and at-grade crossing markings. The “No Train Horn” signs include the time of the partial Quiet Zone from 10 PM – 7 AM. A field review conducted on April 12, 2023, revealed that these devices are still in place, are operational, and are in very good condition.
