The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, July 16th, 2018 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

Dave Ingalls discussed items of concern with the Elmwood Road Apartment Proposal. Questions were asked and answered. After which Trustee Foley moved the following resolution for Final Site Plan Approval of the project at 5 Elmwood Road.

5 Elmwood Road in Menands S.B.L. 55-6-1-3
Whereas, the owners of 5 Elmwood Road, S.B.L. 55-6-1-3, desire to construct a 72-unit multifamily development on said parcel within the Infill Neighborhood District (T4); and

Whereas, the Village Board Issued a Special Use Permit with conditions on March 19, 2018; and

Whereas, the Village Board issued a SEQR Negative Declaration on June 18, 2018; and

Whereas, the Village Board issued Preliminary Site Plan approval with conditions on June 18, 2018; and

Whereas, the applicant has satisfactorily addressed the Preliminary Site Plan approval conditions,

Now, Therefore Be It Resolved that the Village Board hereby issues final site plan approval with the following conditions:

1 The applicant shall make a $5,000 payment to the Village of Menands as a contribution
toward the resurfacing of Elmwood Road and Harts Lane. Payment shall be received by the
Village prior to issuing the Certificate of Occupancy.
2 The applicant shall provide the Village of Menands with a video inspection of the existing
sanitary sewer main extending from the project site to Glenwood Road within 45 days of the
issuance of final site plan approval. If the video inspection suggests that the piping is not in
satisfactory condition or may not have the capacity to accept the discharges from the project,
the applicant may be required to make upgrades.
3 The Village Board must approve temporary easements prior to commencing work on Village
lands, associated with retaining wall construction and asphalt path construction.
4 The applicant must submit a complete design (survey, grading, details, etc.) for the asphalt
path within 45 days of the issuance of final site plan approval.
5 The Village Board and the applicant must enter into a binding and enforceable maintenance
agreement for the proper maintenance of the stormwater management facilities. Within 60 days after final approval.

Mayor Grenier seconded the motion.

As the vote was tied the motion did not pass.

Resident Brian Marsh stated he was baffled at what just happened.

Mayor Grenier asked Chazen Engineer, Eric Johnson to address concerns of some Board members and further explained the water system, including looping. Following a lengthy discussion, the Board authorized Eric to explore options to loop the water system and added conditions for Final Site Plan approval.

After which Trustee Foley offered the following revised resolution for Final Site Plan approval of the project at 5 Elmwood Road Resolution with the additional conditions, motion was seconded by Trustee Boulet.

proposed project and reserves the right to address any upgrades required with the applicant.

Resident Bill Nevins thanked the Board and everyone for their hard work with the fireworks sale. It raised about $3,500.00

A motion was made by Trustee Nicoll to accept the minutes of the July 2nd, 2018 Annual Board Meeting as amended, seconded by Trustee Foley.

There was a discussion regarding an error with the water/sewer accounting system for the period November 1, 2017 to April 30, 2018. Trustee Nicoll offered, seconded by Trustee Boulet the following resolutions:

WHEREAS, Water and Sewer Acct. #510000125 for 269 Broadway in the amount of $941.38 was based on a system error. Now, therefore, be it

RESOLVED, that a total of $324.61 be deducted from the original water roll total for the period November 1, 2017 to April 30, 2018, and be it further

RESOLVED, that a total of $146.08 be deducted from the original sewer roll total for the period November 1, 2017 to April 30, 2018, 2017.

RESOLVED, that a total of $112.80 be deducted from the original sewer roll total for the period November 1, 2017 to April 30, 2018.

Trustee Nicoll made a motion to accept the shelfing and installation bid from ACME Business Systems in the amount of $5,946.84, seconded by Trustee Boulet.

The Clerk has requested that a 2016 Ford Village Police car (VIN #1FAHP2MK9GG104158) that was totaled in a motor vehicle accident be declared surplus.

Trustee Boulet moved, seconded by Trustee Nicoll a motion to declare a 2016 Ford (VIN # 1FAHP2MK9GG104158) as surplus and available for sale.

The Clerk informed the Board that Albany County and Colonie Police are switching to a new CAD System with an estimated cost for the Village of $50,000.00 for the license and maintenance fees of $12,000.00. All police departments in the county are switching. The Mayor stated, per Sgt. acosse, that the Town of Colonie Police Department suggested Menands Police Department wait until they have their CAD System in place before Menands switched over.

Mayor Grenier thanked everyone for their assistance at the Village One meet and greet.
