Board Meeting Minutes – February 20th, 2018

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Tuesday, February 20th, 2018 was called to order by Mayor Megan Grenier at 6:00 P.M.

The Mayor led the Pledge of Allegiance.

At 6:00 P.M. the Mayor opened the Public Hearing for a proposed Local Law # 4 of 2018 Tax Cap Override.

The Clerk read the Notice:

A public hearing will be held on Tuesday, February 20th, 2018 at 6:00 P.M. in the Village Municipal Building at 250 Broadway for a purposed Local Law # 4 of 2018 Tax Cap Override authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c with the regular meeting to follow. Such public hearings are open to the public and are accessible to the handicapped. All are encouraged to attend or to present comments in writing.

LOCAL LAW NO. 4 OF THE YEAR 2018
TAX CAP OVERRIDE
Village of Menands, County of Albany
A local law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c.
Section 1. Legislative Intent
It is the intent of this local law to allow the Village of Menands to adopt a budget for the fiscal year commencing June 1, 2018 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c.
Section 2. Authority
This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body.
Section 3. Tax Levy Limit Override
The Board of Trustees of the Village of Menands, County of Albany, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2018 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c.
Section 4. Severability
If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Effective Date
This local law shall take effect immediately upon filing with the Secretary of State.
Mayor Grenier asked Treasure Smith to explain the authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c. Mr. Smith explained that by authorizing The Tax Cap Override it protects the Village if there was an error in the budget. Mr. Smith also stated that the override can be rescinded. Mayor Grenier stated that NYCOM recommends doing the Tax Cap Override. A question was raised about rescinding the override, Mr. Smith is going to look at the law and get back to the Board.
John Stangle stated he never heard of rescinding the Tax Cap.
Resident Bill Nevins asked amount of the tax override. Mayor Grenier advised we wouldn’t know until the budget was complete.
Resident Mike Magguilli, asked what date the budget needs to be completed by?
Treasurer Smith stated the budget has to be approved by May 1st, the Preliminary Budget needs to be presented by March 20th.
Resident David Rowley asked to keep as close to the tax cap as possible.
Hearing no further questions or comments the Mayor closed the public hearing at 6:10 P.M.

The regular meeting reconvened at 6:10 P.M.

Open Forum:

Resident Bill Nevins thanked DPW for their hard work.
Resident Bill Moreland asked if Glenwood Road was going to be paved because he saw them doing core sampling. DPW Foreman Mike Hagmann advised they looking to possibly paving in the spring.
Resident May Brown asked if Glenwood Road was getting new Water and Sewer lines. Mayor Grenier advised that The Village is completing the south end first.
Residents Bill Moreland and Mary Brown asked clearing the gate at the top of Glenwood. DPW Foreman Mike Hagmann advised that the gates are cleared the next day after plowing. A discussion followed and John Stangle advised that after a fire call they turned around at the top as they usually do. Fire Chief Mike Steurer advised that the Fire Department will only open the gate in an emergency. Discussion followed.
A motion was made by Trustee Harris, seconded by Trustee Boulet to accept the minutes of the February 5th, 2018 Board Meeting.

Trustee Boulet made a motion, seconded by Trustee Harris to approve payment for the following:

PARK IMPROVEMENT: $ 4,303.00

Department Heads presented their Budget Proposals to the Board and answered all questions.

Brian Marsh asked if the Department Heads were given directives before completing their budgets. Treasure Smith read the letter that was given to each Department Head.
Fire Chief Mike Steurer
Reminded to the Board that as agreed this is the budget year to replace a Fire Chief’s Vehicle every three years. Discussion followed.
Fire Chief Mike Steurer request out of this year’s budget one set of turnout gear for a member who has complete all required training.
Trustee Harris made a motion to purchase turnout gear from MES on New York State Contract turnout coat $1,433.87 and Turnout pants $1,523.17 second by Trustee Foley.

Fire Chief Mike Steurer request out of this year’s budget to replace the two Thermal Imaging Camera’s one in Truck 6 and one in Rescue 6, the following quotes were received:
Municipal Emergency Services $ 8,867.53
Draeger $15,272.00
AAA Emergency Supply Co, Inc. $ 7,854.35

Trustee Harris made a motion to purchase two Thermal Imaging Cameras from AAA Emergency Supply Co, Inc. at a cost of $7,854.35 each second by Trustee Foley.

After a discussion it was agreed to schedule the Boards Budget Workshop for Thursday, March 8th, 2018 and Thursday, March 15th, 2018 at 5:30 P.M.

The Public Hearing for the 2018 – 2019 Budget has been set for Tuesday, April 10th, 2018 at 6:00 P.M.

The Clerk informed the Board that Park Reservations will start at 8:00 A.M. on Thursday, March 1st, 2018.
New this year applicant must have a Certificate of insurance from their homeowners or renter’s insurance. If a company is reserving the Village must be named on the Certificate of insurance. If the applicant does not have insurance they cannot reserve the park.

TABELED – After checking with the Village Insurance Agent, it was requested by the Fire Department to use one fire truck and one chief’s car in the St Baldrick’s Parade. A motion was made by Trustee ______, seconded by Trustee ______ to approve this request.

Additional information is required to check the children’s ages to determine whether child car seat or booster seat is needed. It needs to be determined whether this is consider giving rides or using the truck in a parade.

The Clerk informed the Board that Mark Carnegie was elected as Shop Steward and Josh Kinneston elected as Assistant Steward.

Mayor Grenier gave an update and has been done to point in regards to possible flooding within Menands:
On Friday February 16th met with Supervisor Mahan, Colonie Police, Albany County Sheriff Department, State Homeland Security, Red Cross, and Village of Menands
A letter and Albany County Preparedness Flyer was hand delivered to residents of Village One
The State is going to be installing an Aqua Dam at 431 Broadway
DPW picked up 9 pallets of sandbags and delivered to Village One
A State of Emergency has been declared

Resident Bill Moreland had a question regarding 911 and a recent problem he had reporting a police incident. He stated that he was transferred 3 times before getting the Menands Police Department. The Clerk asked if was using his cell phone which he was, the clerk advised him the cell 911 goes to the closes 911 center which is Rensselaer County. Discussion followed.

Trustee Harris stated he has been working with Briana Coughlin regarding the Youth Easter Party which is scheduled for Saturday, March 24th, 1:00 P.M. to 3:00 P.M. the Village Hall located at 250 Broadway.
The Clerk reminded the Board to save April 21st, 2018 for Fire Department Installation Dinner at
Franklin Terrace.

The Clerk relayed information on LED Lighting for the Village, he was asked to obtain quotes.

The Watervliet Youth Soccer will be using the Hallway of the Fire Department on April 8th, 2018 for sign-up.

The Clerk and Village Attorney discussed the Peddler Permit submitted and felt it did not meet the Village criteria.
