Board Meeting Minutes – August 5th, 2019

The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, August 5th, 2019 was called to order by Mayor Megan Grenier at 6:00 P.M.

PRESENT:

ABSENT:

Also attending: Bill Garvey, Kirk Montanye, John Stangle, Mary Robyn Cotrona

The Mayor led the Pledge of Allegiance.

Open Forum:

Resident Bill Garvey stated he is willing to help clean up after the Village Picnic.

Bill thanked DPW for weed removal and removing political signs.

Resident Garvey thanked Officer John Murphy for helping him when a branch fell on his car at the park.

Resident Robyn Cotrona complained about water rates. Resident Cotrona believes she is subsidizing the cost of water for the apartment complexes. A discussion followed.

Resident Cotrona asked about Economic Development why there are no shops in Menands.

Mayor Grenier explained there is a Committee looking into bringing in businesses to the Village. A discussion followed.

A motion was made by Trustee Marsh to accept the minutes of the July 15th, 2019 Board Meeting, seconded by Trustee Foley.

A motion was made by Trustee Marsh to approve payment for the following, seconded by Trustee Foley.

Trustee Foley introduce the following Resolution Granting the State of New York to Perform the Adjustment for the Owner and Agreeing to Maintain Facilities Adjusted Via State-let Contract

RESOLUTION

Resolution # 08052019-1

WHEREAS, the New York State Department of Transportation proposes the construction, reconstruction, or improvement of the Bike-Pedestrian Connector (shared-use path) in the Village of Menands located in Albany County, PIN 1810.74, and

WHEREAS, the Menands’ watermain is located in the vicinity of the DOT construction project. Due to age and deteriorated condition, this watermain may become unstable during construction, reconstruction, or improvement of the above-mentioned project, and

WHEREAS, the service life of the relocated and or replaced utilities has not been extended, and

WHEREAS, the State will provide for the reconstruction of the above-mentioned work, as shown on the contract plans relating to the above-mentioned project.

NOW, THEREFORE,

BE IT RESOLVED, that if the watermain breaks or becomes unstable as a result of the DOT construction activities, the State will include, as part of the construction, reconstruction, or improvement of the above-mentioned project, the relocation, replacement of and/or adjustment to water main and appurtenances, pursuant to Section 10, Subdivision 24, of the State Highway Law, and meeting current standards and the requirements of the owner, and

BE IT RESOLVED, that the Village of Menands approves of the relocation, replacement of and/or adjustment to their water mains and appurtenances and the above-mentioned work performed on the project and shown on the contract plans relating to the project and that the Village of Menands will maintain or cause to be maintained the adjusted facilities performed as above stated and as shown on the contract plans.

BE IT FURTHER RESOLVED that Mrs. Megan Grenier, Mayor of the Village of Menands, has the authority to sign, with the concurrence of the Village Board, any and all documentation that may become necessary as a result of this project as it relates to the Village of Menands and

BE IT FURTHER RESOLVED: That the Clerk of the Village of Menands is hereby directed to transmit five (5) certified copies of the foregoing resolution to the New York State Department of Transportation.

I, Donald Handerhan, duly appointed and qualified Village Clerk, do hereby CERTIFY that the foregoing resolution was adopted at a meeting duly called and held in the office of, 250 Broadway, a quorum being present on the 5th, day of August, 2019 and that said copy is a true, correct and compared copy of the original resolution as adopted and that the same has not been revoked or rescinded.

Trustee Marsh introduced the following Resolution Granting the State of New York Authority to Perform the Adjustment for the Owner and Agreeing to Maintain Facilities Adjusted Via State-let Contract

RESOLUTION

Resolution # 08052019-2

WHEREAS, The New York State Department of Transportation proposes the construction of a share-use path with culvert crossing under the I-787 Southbound On-ramp (Ramp WLD) and modification of an existing driveway on I-787 Northbound On-ramp (Ramp WLB) as part of the Menands Bike-Ped Connection project in the Village of Menands in Albany County, PIN 1810-74, and

WHEREAS, the State of New York will include as part of the above-mentioned project, to provide at no cost to the Village, landscaping feature items including trailhead planting bed(s), plant materials, turf areas, etc., pursuant to Section 10, Subdivisions 27 and 35 of the State Highway Law, as shown on the contract plans relating to the project, and

WHEREAS, the Village of Menands has agreed, at its own expense, to maintain the shared-use path, culvert crossing, and the modified driveway in addition to the landscaping feature items constructed as a part of this project, for a period of at least 30 years, and

WHEREAS, maintenance work performed by the Village of Menands will include trash pick-up, snow and ice removal, mowing grass, maintaining landscaping feature items, and reporting any infrastructure damage to NYSDOT.

NOW THEREFORE,

BE IT RESOLVVED, that the Village of Menands shall maintain at its own expense, such features for a period of at least 30 years, and

BE IT FURTHER RESOLVED, that Mrs. Megan Grenier, Mayor of the Village of Menands, is hereby authorized by the Village Board to enter into and execute an agreement with the State of New York and through the Commissioner of Transportation to maintain these features on the above identified project as it relates to the Village of Menands, and

BE IT FURTHER RESOLVED, that the Village Clerk of the Village of Menands is hereby directed to transmit five (5) certified copies of the foregoing resolution to the New York State Department of Transportation.

The resolution was seconded by Trustee Foley.

Trustee Marsh mad a motion to approve a resolution paying the Village of Menands Annual Dues to the Stormwater Coalition of Albany County in the amount of $9,500.00, seconded by Trustee Foley.

The Clerk advised the Board that we have received the Community Development Block Plan it will be on file in the Village Office and will be scanned for Board Members.

Computel has completed their audit of Spectrum and Spectrum has agreed to pay the $25,834.08 franchise fees owed the Village.

Trustee Marsh made a motion to authorize the Mayor to sign the agreement with Computel and Spectrum, seconded by Trustee Foley.

A discussion was held regarding a resident’s request for the Village to waive penalty charges from their tax bill. After conferring with counsel, the Village cannot waive penalty charges because it’s against New York State Law.

A discussion was held to move the September 23rd Village Board Meeting back to September 16th. After a discussion it was decided to leave the meeting on September 23rd.

The Clerk reminded the Board of the 95th Annual Village Picnic scheduled for, Wednesday, August 21st starting at 5:00 P.M. (rain date Thursday, August 22nd).

At 623 P.M. Trustee Marsh made a motion to enter into Executive Session to discuss legal and personnel matters, seconded by Trustee Foley.
