The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on Monday, April 20, 2026, was called to order by Mayor Brian Marsh at 6:00 P.M.

The Mayor led the Pledge of Allegiance and stated that he is recording the meeting.

Mayor Marsh changed the order of the agenda and asked Matt Rodgers to present the Special Use Permit for 93 Broadway.

Matt Rodgers from LaBella, who has reviewed plans for 93 Broadway Special Use Permit and is recommending conditional approval for 93 Broadway. Discussion followed.

Resolution Number: 260129

Trustee Lane entered the following resolution:

Whereas, the Applicant, YINCAE Advanced Materials, LLC, is seeking Site Plan/Special Use Permit approval to operate a Research and Development facility at 93 Broadway renovate (Parcel: 55.17-1-51.7), and in the Broadway Business District Zoning District, referred to as the “Proposed Project”; and

Whereas, the Applicant submitted a Special Use Permit and Site Plan Application inclusive of a project description, operation statement, survey, safety data sheet, and a Short Form Environmental Assessment Form (EAF) on January 9, 2026; and

Whereas, based on six Review Letters prepared by LaBella Associates, the Applicant submitted additional information to complete the application; and

Whereas, the Proposed Project and all final application documents are more formally described in the attached Notice of Decision; and

Whereas, on February 19, 2026, Albany County Planning Board recommended that the local approval be modified to include NYSDOT review, notification to the Albany County Department of Health, and NYS Department of Environmental Conservation related to storage and disposal of any hazardous materials and waste; and

Whereas, the Proposed Project does not include new or modified access to NYS Route 32 (Broadway) or involve expansion of the existing building; and

Whereas, the Village Board opened and close a public hearing on February 2, 2026; and

Whereas, the Village Board has reviewed Part 1 of the Short EAF, and based upon this review, the Village Board has determined, in accordance with 6 NYCRR Part 617 (State Environmental Quality Review Act or SEQRA) regulations, that the Proposed Project qualifies as a Type II Action and requires no further SEQRA review; and

Whereas, the Village Board has reviewed the application and supplemental information provided against the requirements of the previous Chapter 169 (Zoning) and has determined the application meets the requirements for approval as detailed in the Attached Notice of Decision.

Now, Therefore Be It Resolved that the Menands Village Board hereby issues Special Use Permit and concurrent Preliminary and Final Site Plan approval for the Proposed Project with conditions as indicated on the attached Notice of Decision.

Mayor Marsh advised that there will be a Public Hearing regarding the 2026-2027 Village of Menands Budget. Mayor Marsh opened the Budget Public Hearing at 6:07 PM.

The Clerk read the following notice:
NOTICE IS HEREBY GIVEN that, pursuant to the Village Law, the Preliminary Budget of the Village of Menands for the fiscal year beginning June 1, 2026, and ending May 31, 2027, has been duly filed.

FURTHER TAKE NOTICE that a public hearing will be held on the second floor of the Menands Village Hall, 250 Broadway in the said Village on Monday April 20, 2026, at 6:00 P.M. by the Board of Trustees of the Village of Menands to consider the Preliminary Budget, at which time and place the comments and suggestions of residents of the Village relative to such budget to be enacted will be received. Everyone is encouraged to attend and provide comments either in person or in writing to Clerk Handerhan before noon on February 20, 2026, at dhanderhan@menandsny.gov. These public hearings are open to the public and accessible to individuals with disabilities. You may participate in the Public Hearing in person at the Village Hall on the second floor of 250 Broadway or via the Google Meets link: meet.google.com/mre-txbp-btk or by phone at ‪(US) and1 401-646-0768 PIN: ‪541 841 494#. The Preliminary Budget is on file in the office of the Clerk and may be inspected during office hours or on the Village Website, www.menandsny.gov.

The maximum compensation to be paid to the Mayor is $16,063.00 and each of the four Trustees $9,369.50.

Mayor Marsh gave a presentation of the Village of Menands 2026-2027 Budget.

 

Trustee Lisa Neuman asked about the General Fund was $5000.00 more than last year? Discussion followed.

Trustee Harbour asked if there are any long-term effects by not repaying the Water Fund? Discussion followed.

Public Comment:

Resident Charles Ansert Thanked the board for taking a Business Approach to the Village Budget. Discussion followed

Since there will be the Village Budget Meeting to be held on 4/20/26, I got some important ideas for Menands to find new revenue sources to help our Village produce new money resources and save money as follows:

  1. Sell road salt left over to private businesses.
  2. Sell street, parking lot and sidewalk paving materials like waste gravel, cement and waste oil-based products including lubricants, asphalt, synthetic rubber, diesel, and waste engine oil  to private businesses.
  3. Our Village collect bottles, jugs and cans plus sell them to recyclable dealers. The State of Connecticut  already has this kind of recyclable materials collection program.
  4. Our Village collect newsprint, cardboard, writing paper and several other kinds of paper plus sell wastepaper to paper recycling mills.
  5. Take out garbage collections services out of Village Budget and make it separate fee based on usage.

My own tax money savings:

  1. Buy my own equipment supplies and items when I do Village work and clean up detail products.
  2. Buy notebooks and pencils for our Village.
  3. Give plastic containers to fire and public works Departments free of charge.
  4. My plan is to donate money to help pay for my proposed evergreen forestry conservation projects at Ganser-Smith and Switzer-Polk Parks.
  5. Power all Village public buildings with bio-oil 3s well as continuing to use solar energy.

Resident Mary Lou Smith asked about independent auditors. Discussion followed.

Resident Beth Beshaw asked why the sewer fund must be paid back? Discussion followed.

Resident Steve Boulet asked for update on the Town of Colonie Sewer contract. Discussion followed.

Resident Paul Harbour asked if Businesses taxes are higher? Discussion followed.

Hearing all comments the Mayor closed the Budget Public Hearing at 6:59 PM

Trustee Lane made a motion to approve a one-time General  Fund repayment. “Prior Years Sewer Fund Repayment” of $518,440.00 will be assessed at $1.6933 per $1000.00 of assessed value, seconded by Trustee Marsh.

The discussion regarding the lighting repairs to Car 36 and were the funds to cover the repairs would come from. The cost of the repairs, is $6,260.00 from Auto Solutions, was tabled until the next meeting.

Mayor’s Report:
1. The DPW Contract will be discussed during the May 4, 2026, Board Meeting.
2. Nails on Broadway has opened on Broadway at 281 Broadway

Trustee’s Report:

Neuman:
1. On Wednesday Night the Library will hosing a Virtual Program deal with teaching kids about the Anatomy.
2. Asked everyone to complete the Library’s Strategy Survey.

Kalogridis:
1. CDTA needs to clean up their Bus Stops and area around.

Lane:
1. Gave an update on the Little River Project
2. Diane MacFarland has started cleaning up flower beds.

Harbour:
1. Asked for update on discussion with Railroad. Discussion followed.
2. Asked for an update on Website and Village controlling. Discussion followed.
3. Opening Day for Little League is this Saturday.

Clerk’s Report:
1. The AED located in the Pavilion will be relocated from the closet and installed on the wall near the closet door. The AED cabinet will be equipped with an alarm and an automatic dialer that will contact Colonie Communications and Albany County Dispatch to request a response from Police and EMS. A sign will also be installed next to the cabinet advising that opening the cabinet door will trigger this notification. Discussion followed.
2. CDTA has placed the bikes back in service.
3. September 21, is Yom Kippur do we want to move the Board Meeting to Tuesday?

Treasurer’s Report:
1. Asked Trustee Kalogridis about the Fire Department’s use of Chief’s Vehicles. Discussion followed.

General Comments:

TO: All Menands Village Board Members
FROM: Bill Garvey Jr

I got my own report dealing with some important Village item as follows:

1. He would like to borrow 1 or 2 orange cones to remove graffiti off street marker #8 on Harts Lane
2. He wants to see 25 speed signs installed on most Village Streets except Wards & Simmons Lane.
3. He expresses his frustration regarding the Canadian Pacific Railway in Village as follows:
a. Trains blowing whistles between 10 PM and 7 AM can’t blow whistles at this time   of night.
b. The ruts, cracks, and bumps at railway crossings on Brookside Ave still have not been repaired.
c. Still concerned about flooding from D&H railway tracks onto Menand, Villa & Tillinghast Ave and Station Street.
4. He wrote to Menands Village Officials dealing with operating railway problems plus CPR headquarters to resolve those operation problems.
5. He observed Village Streets in lower Menands having ruts, bumps, cracks, and potholes that those streets need repairs. He reported to Menands Police and Clerk Handerhan.
6. He picked a box up on Tillinghast Avenue.
7. He swept the lobby area at 250 Broadway.
8. He started his litter pickup work projects.
9. How many fire hydrants are in Menands?
a. High pressure hydrants?
b. Low pressure hydrants?
I like to propose that high pressure fire hydrants be red while low pressure hydrants be regular or light green.
10. He supports the Library getting roof repairs and other kinds of building repairs sometime during 2026.
11. He is happy that DOT removed the dead skunk from Broadway.
12. There are highway markers that are missing or in need of repair reported to MPD, DPW,
Clerk Handerhan and DOT.
13. He found a lunch box on Menand Rd and turned it over to MPD for lost and found.
14. He is happy he helped with Menands Fish Fry Events.

Resident Courtney Jaskula Thank everyone for there support of the PTA Yard Sale this past Saturday was a great success.
