The regular semi-monthly meeting of the Board of Trustees of the Village of Menands, held on January 17th, 2012 was called to order by Mayor Megan Grenier at 7:00 P.M.

The Mayor led the Pledge of Allegiance.

Resident Joyce Murphy asked if the Village would be hosting a question and answer meeting for candidates for Village Justice. The Clerk advised her that the Village does not sponsor political debates and that she should contact the candidates.
A motion was made by Trustee Lansing seconded by Trustee Nicoll to accept the minutes of the January 3rd, 2012 meeting.

Trustee Lane made a motion seconded by Trustee Mackay to refund $1,657.79 in water and sewer rents paid by the owner of 4 Oak Ridge. The water meter was never installed and the water was not turned on in the street.

Treasurer Smith recommended that the Village authorize up to $1.2 million in bonding for the Sage Hill Lane – Sky Hollow Drive Water Infrastructure Project.
Trustee Mackay made a motion seconded by Trustee Nicoll to authorize $1.2 million in bonding for Sage Hill Lane – Sky Hollow Drive area.

Trustee Lane offered seconded by Trustee Mackay the following Resolution and moved its adoption pursuant to Election Law § 15-104 1b “The General Election for the Village of Menands will be held on Tuesday, March 20th, 2012 at which time the Village Justice is to be elected for a one year term to commence pursuant to law upon their qualifications and no earlier than April 2nd, 2012.

There was a discussion regarding incorrect water/sewer billings for the period May 1, 2011 to October 31, 2011. Trustee Lansing offered seconded by Trustee Lane the following resolutions:
WHEREAS, Water and Sewer Invoice #2995 for 256 Van Rensselaer Blvd. (service period 05/1/11 to 10/31/11) in the amount of $557.57 was based on an incorrect reading. Now, therefore, be it
RESOLVED, that invoice #2995 be changed to $145.20, reflecting a change in usage from 192,000 gallons to 12,000 gallons, and
RESOLVED, that a total of $412.37 be deducted from the original water roll total for the period May 1, 2011 to October 31, 2011.

WHEREAS, Water and Sewer Invoice #2278 for 48 L Cemetery Avenue (service period 05/1/11 to 10/31/11) in the amount of $9,094.21 was based on an incorrect reading. Now, therefore, be it
RESOLVED, that invoice #2778 be changed to $1,793.90, reflecting a change in usage from 2,576,000 gallons to 453,000 gallons, and
RESOLVED, that a total of $7,300.31 be deducted from the original water roll total for the period May 1, 2011 to October 31, 2011.

There was a discussion regarding incorrect water/sewer billings for the period May 1, 2011 to October 31, 2011. Trustee Mackay offered seconded by Trustee Lane the following resolutions:
WHEREAS, Water and sewer Invoice #3017 for 11 Wards Lane (service period 05/01/11 to 10/31/11) in the amount of $65,132.30 was based on an incorrect reading. Now, therefore, be it
RESOLVED, that invoice #3017 be changed to $11,518.74, reflecting a change in usage from 14,058,000 gallons to 1,994,000 gallons, and
RESOLVED, that a total of $33,508.48 be deducted from the original water roll total for the period May 1, 2011 to October 31, 2011, and be it further
RESOLVED, that a total of $20,105.08 be deducted from the original sewer roll total for the period May 1, 2011 to October 31, 2011.

The Treasurer requested that the board transfer $25,000 from the General Fund unappropriated fund balance to $17,000 to A.9089.0800 Compensated Absences (due to 3 retirements last year) and $8000 to A.8160.0419 Refuse-Vehicle Maintenance (due to a new engine for the recycling truck). After a discussion Trustee Lansing moved seconded by Trustee Nicoll a motion authorizing the transfer of $25,000 from the General Fund Unappropriated Fund to A.9089.0800 Compensated Absences $17,000 and to A.8160.0419 Refuse Vehicle Maintenance $8000.

Trustee Nicoll reported that the committee for proposed ice skating rink will be at the next Board Meeting to answer questions from the Board.
Trustee Mackay reported that Broadblast has set up a test page for the Village’s First Call System and requested that department heads review the page and report their comments to Kathy Lanni.
Mayor Grenier appointed Lisa Anne Proskin to the position of Village Justice to a term ending April 2, 2012.
Mayor Grenier reported that the next activities will have a notice that the Village will be requesting applications for a position of a part time Economic Development Coordinator and that she will have an update of Village government actions in the next two activities.
Mayor Grenier explained that the Village received an invitation to the Colonie Chamber of Commerce’s Annual Dinner Party on January 27th at the Century House. The cost is $80.00 per person.
The Mayor reported that a new business Lapiner Company hosted their Grand Opening at 242 Broadway on January 13, 2012.
The Mayor led a discussion on the Village’s participation in the Town of Colonies Community Development Program. Trustee Lane will report on the areas in the Village that are eligible.
Trustee Lansing noted that the deadline for applications is February 17, 2012 and requested that a Public Workshop on possible projects be held on February 2, 2012 at 6:00 P.M. in the Village Hall.
The Mayor led a discussion on a lawsuit for an Order to Show Cause that was served on the Village by Trustee Lane and Stanley Segal. Village Attorney Rehfuss noted that the action against the Village was closed and is now a matter of public record, allowing the discussion regarding this case to be discussed in a public meeting. Village Attorney Rehfuss reported that relief sought in the Order to Show Cause had been posted before the Order to Show Cause was served and that the case was dismissed. Trustee Lansing stated that former Village Justice David Rowley left his position on very short notice and left several cases pending and left the Village in a difficult position to resolve some of the cases.
A motion was made by Trustee Lansing seconded by Trustee Mackay to adjourn.
